OVERVIEW

Welcome to Apparel Alchemists.

The terms “we”, “us” and “our” refer to Apparel Alchemists.

Apparel Alchemists operates this online store and website, including the information, content, features, products and services made available through it (collectively, the “Services”).

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer and sell our products to you.

Many of our products are produced and fulfilled on demand by our fulfilment partner Printful and, where necessary, other approved service providers.

These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies referred to on our website, explain the terms that apply when you access our website or purchase from Apparel Alchemists.

By accessing, browsing or using our Services, you agree to these Terms.

Nothing in these Terms limits or excludes any statutory consumer rights that cannot legally be limited or excluded.

SECTION 1 – ACCESS AND ACCOUNTS

You must have the legal capacity to enter into a contract in order to purchase products from Apparel Alchemists.

If you create an account with us, you are responsible for keeping your login information secure and for activity carried out through your account.

When placing an order, you agree to provide accurate, current and complete information, including your name, email address, billing information and delivery address.

Please check your information carefully before completing your order.

SECTION 2 – OUR PRODUCTS

We make every reasonable effort to display and describe our products accurately.

However, colours may appear slightly different depending on your screen, device settings and display configuration.

Because many Apparel Alchemists products are printed or manufactured individually on demand, minor variations in print placement, colour reproduction or finish may sometimes occur as part of the production process.

These reasonable production variations do not affect your statutory rights where an item is faulty, materially different from its description or otherwise does not conform to your order.

Product photographs and mock-ups are intended to represent the finished product as accurately as reasonably possible.

Product descriptions, specifications, colours, sizes and availability may be updated from time to time.

We reserve the right to discontinue products or change our range without notice.

SECTION 3 – MADE-TO-ORDER PRODUCTS AND PRINTFUL

Many Apparel Alchemists products are made specifically after an order has been placed rather than being held as finished stock.

We currently use Printful as a production and fulfilment partner for many of our products.

Depending on the product, destination, stock availability and production method, an order may be manufactured and dispatched from different fulfilment facilities.

Printful acts as a service provider to Apparel Alchemists. Your purchase contract is with Apparel Alchemists, not Printful.

Questions, complaints, cancellation requests, refund requests and other customer-service enquiries relating to purchases from our website should therefore be directed to Apparel Alchemists.

Unless a product is expressly described as personalised, customised or made to your individual specification, the fact that it is produced after your order is placed does not by itself remove any cancellation or return rights provided to you by applicable consumer law.

SECTION 4 – ORDERS

When you place an order through our website, you are making an offer to purchase the products in your order.

Receiving an automated order confirmation means that we have received your order. It does not necessarily mean that we have accepted it.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable;

  • payment cannot be authorised;

  • there is an obvious pricing or description error;

  • we cannot deliver to the address supplied;

  • fraud or unauthorised activity is reasonably suspected; or

  • fulfilling the order would breach applicable law.

If we cancel an order after payment has been taken, any amount due to you will be refunded.

Because made-to-order products can enter production quickly, we may not always be able to change an address, size, colour, design or other order information once fulfilment has started.

Please therefore check your order carefully before completing checkout.

This does not affect any statutory cancellation or consumer rights that apply to your purchase.

SECTION 5 – PRICES, PAYMENTS AND TAXES

Prices are shown on our website in the currency selected or displayed by the store.

The total amount payable, including applicable delivery charges and taxes where required, will be shown during checkout before you complete your purchase.

Prices, discounts and promotions may change without notice, but changes will not normally affect an order that we have already accepted.

Payment must be successfully authorised before an order can proceed to fulfilment.

Payments may be processed through Shopify Payments or other payment providers made available through our Shopify store.

You agree to provide accurate and authorised payment information.

For international orders, customs duties, import taxes or handling charges may apply depending on the destination, fulfilment location and applicable local laws. Where such charges are the customer's responsibility, this will be subject to applicable consumer law and the information provided through our Shipping Policy or checkout.

SECTION 6 – SHIPPING AND DELIVERY

Because many products are made to order, estimated delivery time may include both:

  1. production and fulfilment time; and

  2. shipping time.

Delivery dates shown on our website or during checkout are estimates unless expressly stated otherwise.

Orders may be fulfilled from different Printful facilities depending on product availability, destination and production method.

We are not responsible for delays caused by circumstances genuinely outside our reasonable control, including severe weather, customs processing, carrier disruption or other exceptional events.

However, nothing in this section removes any legal rights you may have where an order is significantly delayed or is not delivered within an agreed or legally required timeframe.

Risk of loss or damage remains with Apparel Alchemists until the goods are delivered to you, or to another person identified by you to receive them, except where applicable law provides otherwise.

Please ensure that the delivery address you provide is complete and accurate.

If an order cannot be delivered because an incorrect or incomplete address was supplied, reasonable additional delivery costs may apply if reshipment is requested.

SECTION 7 – RETURNS, CANCELLATIONS AND REFUNDS

Returns, cancellations, replacements and refunds are governed by our Refund Policy and applicable consumer law.

If an item arrives:

  • damaged;

  • defective;

  • misprinted;

  • materially different from what you ordered; or

  • otherwise not as described,

please contact us as soon as possible.

We may request your order number, details of the issue and clear photographs so that we can investigate the problem and, where appropriate, raise a production claim with Printful.

Printful currently provides merchant remedies for qualifying damaged, defective, incorrectly printed or lost orders, but your rights as a customer are against Apparel Alchemists, and are not limited to whatever remedy our fulfilment provider offers us.

Where applicable law gives you a right to cancel an online purchase because you have changed your mind, those rights will be honoured.

Certain personalised or genuinely custom-made products may be excluded from change-of-mind cancellation rights where permitted by law. Any such exclusion does not affect your rights where the goods are faulty, damaged or not as described.

Please contact us before returning an item. Do not return products directly to Printful or to an address printed on the original parcel unless we specifically instruct you to do so.

Nothing in our Refund Policy or these Terms affects your statutory consumer rights.

SECTION 8 – PRODUCT AVAILABILITY

Products, colours, sizes and other variants may occasionally become unavailable after an order is submitted.

Where this happens, we may:

  • offer a suitable alternative where appropriate;

  • contact you to discuss available options;

  • remove the unavailable item from the order and refund it; or

  • cancel and refund the affected order.

We will not intentionally substitute a materially different product without appropriate notice or consent where required.

SECTION 9 – INTELLECTUAL PROPERTY

Unless otherwise stated, the content available through Apparel Alchemists, including our:

  • artwork;

  • characters;

  • illustrations;

  • designs;

  • logos;

  • names;

  • slogans;

  • graphics;

  • photographs;

  • written content;

  • videos; and

  • website design

is owned by or licensed to Apparel Alchemists and is protected by applicable copyright, trademark and intellectual property laws.

This includes, where applicable, Apparel Alchemists characters, artwork, symbols and original design elements.

You may use our website for personal and non-commercial purposes only.

You must not copy, reproduce, modify, distribute, sell, publish, commercially exploit or create derivative works from our protected material without prior written permission from Apparel Alchemists, except where permitted by law.

The names and trademarks of Shopify, Printful and any other third parties belong to their respective owners.

SECTION 10 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES

Our website may provide access to services, applications or tools operated by third parties.

These may include payment providers, analytics services, social-media platforms, review services, marketing applications and other Shopify integrations.

Third-party services may be governed by their own terms and privacy policies.

Where you choose to interact directly with a third-party service, you should review the applicable terms before using it.

Nothing in this section excludes any responsibility that Apparel Alchemists has to you under applicable consumer law.

SECTION 11 – THIRD-PARTY LINKS

Our website may contain links to websites or services operated by third parties.

We do not control third-party websites and are not responsible for their content, availability or independent practices.

A link from Apparel Alchemists does not necessarily mean that we endorse the third party or everything available through its website.

Any purchases you make directly from an unrelated third-party website will be subject to that third party's terms.

SECTION 12 – RELATIONSHIP WITH SHOPIFY

Our ecommerce store is hosted and powered by Shopify.

Shopify provides technology that allows us to operate the website, process orders and provide certain ecommerce functionality.

However, when you purchase an Apparel Alchemists product through our website, your sale is with Apparel Alchemists.

Shopify is not the retailer of Apparel Alchemists products.

SECTION 13 – RELATIONSHIP WITH PRINTFUL

Printful provides print-on-demand manufacturing, packaging, fulfilment and shipping services for many of our products.

When necessary to fulfil an order, relevant order information may be supplied to Printful.

Printful does not receive your retail payment on behalf of Apparel Alchemists and is not the retailer from whom you purchased the product.

Apparel Alchemists remains responsible for its relationship with you as the customer.

You should therefore contact Apparel Alchemists, rather than Printful, regarding an order placed through our website.

SECTION 14 – PRIVACY AND CUSTOMER INFORMATION

Personal information collected through our website is handled in accordance with our Privacy Policy.

Because our website is powered by Shopify and our products may be fulfilled by Printful, information necessary to process your order may be shared with service providers involved in providing the Services.

This may include information such as:

  • your name;

  • email address;

  • telephone number where provided;

  • billing information;

  • delivery address;

  • products ordered; and

  • other information reasonably required to process, fulfil or deliver your order.

We only share information as necessary and in accordance with applicable data-protection law and our Privacy Policy.

SECTION 15 – REVIEWS, FEEDBACK AND SUBMISSIONS

If you voluntarily send us reviews, comments, photographs, suggestions or other feedback, you confirm that you have the right to provide that material.

Where you submit a review or other content for publication, you grant Apparel Alchemists permission to display and use that material in connection with our business, website and marketing, subject to applicable law and any permissions communicated when the content is submitted.

You must not submit material that infringes another person's intellectual property, privacy or other legal rights.

We may remove unlawful, misleading, abusive, fraudulent or otherwise inappropriate content where reasonably necessary.

SECTION 16 – ERRORS AND INACCURACIES

Occasionally, our website may contain typographical errors, inaccuracies or omissions relating to matters such as:

  • product descriptions;

  • prices;

  • promotions;

  • availability;

  • delivery charges; or

  • estimated delivery times.

We may correct genuine errors and update information where reasonably necessary.

If a significant error affects an order you have already placed, we will contact you where appropriate and provide any remedy required under applicable law.

SECTION 17 – PROHIBITED USES

You may not use our website or Services:

  • for unlawful purposes;

  • to violate applicable laws or regulations;

  • to infringe our intellectual property rights or the rights of another person;

  • to transmit malicious software;

  • to attempt unauthorised access to our systems;

  • to collect personal information about others unlawfully;

  • to impersonate another person;

  • to submit fraudulent orders;

  • to interfere with the security or normal operation of the website; or

  • to use automated scraping, crawling or similar technology in a way that damages or disrupts the Services.

We may restrict or terminate access where we reasonably believe these Terms have been seriously breached.

SECTION 18 – STATUTORY RIGHTS AND WARRANTIES

Nothing in these Terms excludes, restricts or attempts to remove rights granted to consumers by applicable law.

Where consumer law applies, products supplied by Apparel Alchemists must meet the legal standards that apply to them, including where relevant being:

  • of satisfactory quality;

  • fit for their intended purpose; and

  • as described.

Any wording elsewhere on our website must be interpreted consistently with these statutory rights.

SECTION 19 – LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms limits any liability or consumer right that cannot legally be excluded.

Subject to those protections, Apparel Alchemists will not be responsible for losses that were not reasonably foreseeable when the contract was entered into, or losses resulting from events genuinely outside our reasonable control.

We do not exclude liability for fraud, fraudulent misrepresentation or any other liability that applicable law states cannot be excluded or limited.

SECTION 20 – TERMINATION AND SUSPENSION

We may suspend or terminate access to parts of our Services where reasonably necessary, including where a user seriously or repeatedly breaches these Terms, acts unlawfully or threatens the security of the website.

Termination does not affect rights or obligations that arose before termination.

Provisions that are intended by their nature to continue after termination, including intellectual property provisions, will continue to apply.

SECTION 21 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed only to the extent necessary.

The remaining provisions will continue in effect.

SECTION 22 – ENTIRE AGREEMENT AND WAIVER

These Terms, together with the policies referred to within them, form the agreement governing your use of our website and purchases through Apparel Alchemists.

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

Nothing in these Terms overrides mandatory consumer rights.

SECTION 23 – GOVERNING LAW

These Terms are governed by the laws applicable to the jurisdiction in which Apparel Alchemists is established, subject to any mandatory consumer protections that apply to you.

If you are a consumer, nothing in this section prevents you from relying on any mandatory rights available under the laws of your country of residence or from bringing proceedings in a court where applicable law gives you that right.

SECTION 24 – CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to:

  • our business;

  • our products;

  • Shopify or Printful services;

  • applicable laws;

  • payment or fulfilment arrangements; or

  • the operation of our website.

The latest version will be published on this page together with its updated date.

Changes will not retrospectively remove rights that have already arisen under an order.
